Terms of Sale
Effective October 13, 2026
These Terms and Conditions of Sale (the “Terms”) govern the contractual relationship between Daniel Baud (the “Seller”), a sole-trader business located at 65 rue Pouchet, 75017 Paris, registered with the Paris Trade and Companies Register under number 503 871 196 00013, and any individual acting outside a commercial capacity (the “Customer”) making a purchase through the website https://danielbaud.com (hereinafter the “Website”).
Before any transaction, the Customer acknowledges having read these Terms and expressly accepts them by clicking the order confirmation button.
ARTICLE 1 — Purpose
These Terms define the conditions of sale between the Seller and the Customer, covering orders, payment, delivery and services. They govern every step required to place an order and its follow-up between the contracting parties.
ARTICLE 2 — Products
The Products covered by these Terms are those listed on the Website as sold and shipped by the Seller. They are offered subject to available stock of the raw materials needed to make them.
Products are described and presented as accurately as possible. However, the Seller cannot be held liable for any errors or omissions in that presentation. Product photographs are not contractually binding.
All items offered on the Website are made to order unless expressly stated otherwise.
ARTICLE 3 — Prices
Product prices are shown in euros (€), inclusive of all taxes and the VAT rate applicable on the order date. Any change in the applicable rate may be reflected in Product prices.
The prices shown exclude shipping costs, which are charged in addition to the purchased Products according to the order total. Shipping costs are displayed before the Customer confirms the order.
The Seller reserves the right to change prices at any time but agrees to apply the prices displayed when the order is placed, subject to availability on that date.
ARTICLE 4 — Orders
The Customer places an order on the Website. To purchase one or more items, the following steps must be completed: select items and add them to the bag, confirm the bag contents, identify yourself on the Website if required, choose a delivery method, choose a payment method and accept the Terms (including withdrawal conditions), then confirm payment.
Confirming the order constitutes acceptance of these Terms, acknowledgment of full knowledge of them and a waiver of the Customer’s own purchase conditions. All information supplied and the recorded confirmation serve as evidence of the transaction.
ARTICLE 5 — Payment Terms
Payment is due when the order is placed. The Customer can pay by card or through PayPal. Card payments are processed through PayPal’s secure system using SSL (Secure Socket Layer), which encrypts transmitted information so that third parties cannot read it while it travels over the network.
The Customer’s account will only be charged (payment captured) when the Seller starts production, following an initial authorization at checkout. An order confirmation is emailed after authorization.
ARTICLE 6 — Cancellations, Returns and Refunds
This section sets out the specific conditions that apply to our made-to-order garments.
6.1 Cancellation Before Shipping
- Before production is approved: You can cancel items immediately, free of charge, from your account, even after 48 hours. The boutique can only approve production and capture payment after the first 48 hours. Canceling the entire order releases the payment authorization; for a partial cancellation, only the retained items and the previously agreed shipping costs will be charged.
- After production is approved and before shipping: The boutique processes your request to stop production. The affected items are refunded in full, with no flat-rate penalty. Standard shipping costs are included when withdrawing from the entire order.
Cancel through My Account → My Orders or by contacting customer service.
6.2 Right of Withdrawal
Standard-size garments are covered by the withdrawal right, including preorders, made-to-order pieces and limited editions. You have 14 calendar days, starting the day after you receive the last item in your order, to notify us of your withdrawal without giving a reason. If the period ends on a Saturday, Sunday, public holiday or non-working day, it is extended to the next working day.
6.3 Return Conditions and Refunds
Notify us through My account → My orders, our withdrawal form, or a clear statement sent to customer service. You then have 14 days to send the items back.
Items should be returned clean and undamaged. Normal trying on is allowed. Keep labels and packaging where possible. Makeup, perspiration or signs of use beyond normal trying on may result in a deduction for an actual, documented and proportionate loss of value—never a flat-rate penalty or an automatic refusal of withdrawal.
You may carefully try on a garment to check its size and fit, as you would in a store. Wearing it out goes beyond that fitting. Makeup, perspiration marks, stains or damage caused by excessive handling may make you liable for the actual loss in value (Article L221-23 of the French Consumer Code), provided you were informed of your right of withdrawal beforehand. Any loss is assessed individually after inspection, based on findings and supporting evidence; it never results from a flat-rate percentage. The amount, calculation and evidence are emailed to you. You may dispute them with customer service and then use the dispute-resolution procedures in the Terms. Your right of withdrawal remains intact; depreciation does not automatically justify refusing a return. A defect present on delivery or wear from normal fitting does not justify such a deduction.
Made-to-Measure Garments
Made-to-measure items: only garments actually made to your personal measurements fall within the exception to the withdrawal right under Article L221-28(3) of the French Consumer Code. This exception does not apply to standard sizes, even when made to order. It never removes statutory guarantees of conformity or against hidden defects. Contact us to exercise these guarantees if there is a defect or lack of conformity. For an order containing both types of items, each set of rules applies to the relevant items. Requesting an atelier appointment does not place an order or constitute acceptance of these terms.

You pay the direct cost of returning items if you change your mind. The boutique covers returns caused by a defect or an error on our part, without affecting your statutory guarantees.
The relevant items are refunded in full, subject only to any legally justified loss of value caused by handling beyond normal trying on, with no flat-rate penalty. Original standard delivery charges are refunded if you withdraw from the entire order and are not reduced by such a deduction. As our delivery charge is a flat rate, it is retained if you keep part of the order; any express delivery surcharge remains at your expense. Refunds are made to the original payment method, at no charge, within 14 days of notification. For dispatched items, we may withhold the refund until we receive the goods back or receive proof of their return shipment, whichever occurs first.
The form and sample withdrawal statement are available on the Returns and Withdrawal page. Accepting the Terms does not waive your statutory rights.
6.4 Nonconforming or Defective Products
If a Product arrives defective, damaged or not as ordered, the Customer must contact customer service as soon as possible. The Seller will cover return costs and, after verification, offer the Customer a choice of a full refund, repair or exchange. These provisions do not deprive the Customer of statutory warranties (see Article 8).
6.5 Refund Procedure
Refunds are made to the original payment method, at no charge, within 14 days of notification. For dispatched items, we may withhold the refund until we receive the goods back or receive proof of their return shipment, whichever occurs first.
ARTICLE 7 — Shipping
Products are delivered to the shipping address provided at checkout, within the timeframe shown on the order confirmation page (up to 10 business days for production, followed by 3 business days for transit within metropolitan France, excluding weekends and national public holidays; for made-to-measure items, the timeframe begins once measurements are approved).
If shipping is delayed, the Customer will be emailed about any impact on the stated delivery timeframe. In the event of a delivery delay, the Customer may terminate the contract under the conditions and procedures set out in Article L216-2 of the French Consumer Code.
International Shipping
The Seller offers delivery to selected destinations outside metropolitan France (China, South Korea, the United States, Japan and the United Kingdom). Destination-specific shipping costs and estimated delivery times are calculated and displayed before the order is confirmed.
For deliveries outside the European Union, the Customer is considered the importer of the Products. Customs duties, local taxes, import duties or government taxes may apply. These charges are outside the Seller’s responsibility and are payable solely by the Customer, who is fully responsible for declarations and payments to the relevant authorities in their country. We recommend checking with local authorities before ordering.
ARTICLE 8 — Statutory Warranties
Products supplied by the Seller automatically benefit, at no extra cost and independently of the right of withdrawal or commercial returns policy, from the following statutory warranties:
- The statutory conformity warranty for Products that appear defective, damaged or not as ordered (Articles L217-4 et seq. of the French Consumer Code).
- The statutory warranty against hidden defects in materials, design or manufacturing that affect delivered Products and make them unfit for use (Articles 1641 et seq. of the French Civil Code).
To exercise these rights, the Customer must notify the Seller in writing of any nonconformity or hidden defect once discovered.
ARTICLE 9 — Liability
In the distance-selling process, the Seller is subject only to an obligation to use reasonable care. The Seller cannot be held liable for damage resulting from Internet use, such as data loss, intrusion, viruses, service interruption or other unintentional issues.
ARTICLE 10 — Intellectual Property
All Website content (trademarks, logos, text, photographs, etc.) remains the Seller’s exclusive intellectual property. No part may be reproduced, exploited or used in any way, even partially, without the Seller’s prior written consent.
ARTICLE 11 — Personal Data
The Seller undertakes to keep the purchaser’s information confidential, including information provided to use certain services. This information is subject to French Law No. 78-17 of January 6, 1978. Users have the right to access, correct and delete their information and may request this at any time by writing to the Seller’s address or by email. For more information, see our Privacy Policy.
ARTICLE 12 — Governing Law, Language and Disputes
Daniel Baud is established in France. These Terms are governed by French law and applicable European rules. This choice does not deprive consumers of mandatory protections under the law of their country of habitual residence where applicable, notably under Article 6 of the Rome I Regulation. The French text is the reference version; translations are provided to aid understanding without limiting consumers’ statutory rights.
In the event of a dispute, the Customer should first seek an amicable resolution with the Seller by contacting customer service: contact@danielbaud.com.
If no amicable agreement is reached, the Customer may bring the matter before a court with territorial jurisdiction under the French Code of Civil Procedure, or the court for the place where the Customer lived when the contract was concluded or the harmful event occurred.
Under Article L612-1 of the French Consumer Code, the Customer may also use consumer mediation free of charge after first submitting a written complaint to the Seller. General information about mediation is available on the official consumer mediation website.
The appointed mediator is CMAP (Paris Mediation and Arbitration Center), 39 avenue Franklin D. Roosevelt, 75008 Paris. Referrals are subject to CMAP’s eligibility requirements and must follow a prior written complaint to the boutique, using the CMAP consumer mediation form. This process is free for the consumer.
ARTICLE 13 — Precontractual Information and Customer Acceptance
The Customer acknowledges having received, before placing the order and entering into the contract, these Terms and all information listed in Article L221-5 of the French Consumer Code in a clear and comprehensible form.
By ordering on the Website, an individual or legal entity fully accepts these Terms and the obligation to pay for the Products ordered. The Customer expressly acknowledges this and, in particular, waives reliance on any conflicting document, which would not be enforceable against the Seller.
